Dear Claudia, I have a company in the UK in IT/Advertising Services, I wish to trade with Portuguese businesss, and to become resident there for a while. Is it possible to open a branch office in Portugal, and pay personal tax on my renumeration from the UK company in Portugal? Also the trailer is UK registered at present but I am thinking to work here for 6 months only per year, returning to the UK for 6 months. Will I need to import the trailer via IMTT to do this or can I work for 183 days here, with an ambulent licence and pay tax for 6 months here only and 6 months in the UK? Thank you for your question. You don't need portuguese residency to start a business or to come to Portugal, since you are a British citizen, you will only need a fiscal number. You come to Portugal to develop an activity, so you must register as a self employed and you must pay taxes from the time you will be here developing your activity.
The trailer will need also a permit via IMTT. We will be able to help you with the process, in case you decide to come to Portugal

Before buying I might want to buy Portuguese Government Bonds as I believe they are sitting at quite a high interest rate at the moment. I am getting only 8% in South Africa. My father just died in South africa and left me some money that I woul like to move to Portugal and invest with the possibility of borrowing against it to buy an existing business near Coimbra. The business is a family owned and run resturant along a main tourist road with no immediate competitors. So ity loks like a good opportunity at this stage. Obviously I would have to otae a closer look and arrange a bank loan to finance startup etc ... Do you think this would be at all possible. I have a Portuguese passport and will be arriving realistically to settle in Aveiro in about 6 months time. You do, however, mention IMT in your last answer, which I think is a Property Transfer Tax. Within Portuguese tax law, are there any circumstances at all in which it is possible to get a refund of IMT from the government? e.g. the property is being purchased by a non-resident for business purposes? Even if you are a company and buy an property, there is no VAT, because you pay IMT

Cláudia AzevedoDear Claudia I purchased an apartment in Portugal in May 2010 which I rent to tourists as holiday accommodation. The property was constructed in 2007 and the developer rented out the property to tourists before selling it on to me. My purchase contract simply discloses the price I paid, without any mention of VAT. Given that I purchased the property as a business venture (i.e. to rent to tourists), I have questioned the VAT-status of this transaction. The vendor has stated that "in Portugal, VAT is not due on the purchase of real estate properties and therefore there was no VAT included in the purchase price of your property". However, in the UK, holiday accommodation does attract VAT when purchased, provided that it is less than 3 years old. Does the same VAT rule apply in Portugal? Assuming that the VAT rules are consistent and given that the property was being purchased for business purposes, should the vendor have charged VAT, or can I assume now that the purchase price did actually include Portuguese VAT? Cláudia AzevedoDear Claudia, In 2007 I was advised by a lawyer in Oporto to set up a company since it was my intention to buy and renovate ruins. We set up an SA and I bought 2 ruins. Unfortunately, with the economic crisis in 2008 my resources were affected plus the architect appointed has taken 3 years to obtain planning. (He was not a real architect, I later discovered.) I have had all sorts of problems with my representatives in Oporto (one of them, the procurador) who is my cousin. I am in the process of selling one of the properties but my cousin failed to register the land and I am now having to pay a lawyer in Serta to correct this error. Fortunately the buyers understand are still continuing with the purchase. Building has started on the second property in Dornes. Essentially, I would like to move the Company HQ, change accountant and remove my cousin from his role as procurador of the company. I have sought advice about closing down the company but am told that I cannot do this now that I have commenced construction in Dornes. I am told I have to wait until I have sold the property before I can close down the company. Do you know anyone who I could trust to look after my affairs in Portugal and what is your advice? I have tried to register the business name Atlasps property services with the portuguese authorities but, they rejected it and only offered me a list of disused portuguese busines names none of which were suitable as, my client base will be uk owners of holiday accomodation. Prior to the registration process, I did a lot of promotional work IE leaflet drops, corporate clothing website etc etc it will be a big expense to lose just for a name change! You have two ways to do that: first we will do that for you or you go to local finances and ask a fiscal number, but if you are not resident you will need a fiscal representative. Thank you for your contact. To reclaim VAT there are some maps that the accountant must fill, usualy we reclaim quarterly. The minimum value to reclaim is 249,40 Euros, and if the value is from 249,4 until 5937,50 Euros the entity must be more than 6 months.

Can I be single share holder even if I am a foreigner? Is it difficult to get the paperwork done? How much money do we need to get everything done? What other expenses do we expect beside the $5000 capital? how much would the licences, insurance cost? how much time for everything to be set up? can the rental fees (location for the store, equipment) be deducted from our taxes? The social capital (5.000 euros) is for you to face the expenses from the society. From that money you will need 360 euros to constitute the company. Dear Claudia I have a number of holiday properties on the silver coast. What tax advantages are their in leaving the profits in portugal to re-invest in further projects. So if you leave your profits here it will be as a person not as a legal firm or self employed, correct? In the UK you declare your income from Portugal, but here in Portugal you don't declare anything, correct? How is your taxes aply to your income in the UK?
